1. General
These terms and conditions apply to all services provided by Benelux Trade Link BV and to the use of this website. By requesting a quote or engaging our services, you accept these terms.
2. Services
Benelux Trade Link arranges freight forwarding, transport, warehousing, customs and related logistics services. All services are performed in accordance with the Dutch Forwarding Conditions (FENEX), latest version, filed with the courts of Amsterdam and Rotterdam, unless expressly agreed otherwise in writing.
3. Quotations
Quotations are free of charge and without obligation. Quoted rates are valid for the period stated in the quotation and are subject to carrier availability, currency fluctuations, and surcharges imposed by third parties (such as fuel or security surcharges).
4. Customer Obligations
The customer is responsible for providing accurate and complete information about the cargo, including weight, dimensions, value and any hazardous characteristics. The customer warrants that the goods are properly packed and labelled, and that all documentation supplied is truthful and complete.
5. Liability
Our liability is limited in accordance with the applicable FENEX conditions and mandatory international conventions (such as CMR, Hague-Visby and Montreal). We strongly recommend arranging cargo insurance, which we can quote on request.
6. Payment
Invoices are payable within the term stated on the invoice. In the event of late payment, we reserve the right to charge statutory commercial interest and collection costs.
7. Website Use
The content of this website is provided for general information only and does not constitute a binding offer. We make reasonable efforts to keep information accurate but accept no liability for errors or omissions.
8. Governing Law
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
9. Right of Withdrawal (EU Consumers)
If you are a consumer within the meaning of Directive 2011/83/EU on consumer rights, you may have a statutory right to withdraw from a distance contract within 14 days. This right does not apply to transport and logistics services that have been fully performed with your prior express consent, or where performance has begun at your explicit request before the withdrawal period expired.
10. Online Dispute Resolution
In accordance with Regulation (EU) No 524/2013, consumers in the European Union may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and do not commit, to participate in alternative dispute resolution proceedings before a consumer arbitration board.
11. Data Protection
Personal data provided in connection with our services is processed in accordance with Regulation (EU) 2016/679 (GDPR) as described in our Privacy Policy.
